Proposed consolidated Covenants for Creekside HOA.
Why
The original Covenants for Creekside consist of six (6) separate filings. This creates a few challenges for enforcement. For example, one filing of the Covenants expressly prohibits the planting of trees in the strip between the sidewalk and the street while the other filings do not. In the absence of a consolidated set of Covenants, the approach has been to apply the most stringent requirement to all filings for the sake of consistency. Additionally, the original Covenants were intended for new construction and are several decades old. So they do not, for example, address the question of whether short term rentals (AirBnB or similar) should be permitted. And we (the HOA Directors and Officers) think these are important issues that impact the quality of the neighborhood. Additionally, there have been changes in Colorado law regarding homeowners associations like Creekside that must be addressed. The solution is to create a consolidated set of updated Covenants that will apply rules consistently across all addresses in Creekside.
When
The proposed consolidated Covenants were initially posted on May 10, 2022 and a Town Hall was held on June 15, 2022. All comments received can be found here. Based on the feedback, revisions were made. Ballots were mailed on August 29, 2022 and results are posted.
